EuGH annulliert Einstufung von TiO2-Pulver als vermutlich krebserzeugend (Carc 2)

TiO2-Pulver, das mindestens 1% Partikel mit einem aerodynamischen Durchmesser von < 10 µm enthält, musste seit 01.10.2021 als vermutlich krebserzeugend (Carc 2) eingestuft werden. Das Urteil vom EuGH, das nun rechtkräftig wurde, annulliert die Entscheidung der Europäischen Kommission mit der Begründung, dass es bei der Auswertung der vorliegenden Studien zu Fehleinschätzungen durch die Behörde gekommen ist und die Einstufung und damit verbundene Kennzeichnung nicht der gültigen Rechtsprechung entspricht.
